Refunds & Returns

As Each Item is pretty much a custom Creation and is made for you as well as we are a very small business we have an extremely tight and limited returns policy.

We have a 14 day refund policy which means you have 14 days after the receipt of your item in order to request a refund of the item.  If more than 14 days have passed since your purchase, we can’t offer you a full refund or exchange.

Order Cancellation

Yes, orders can be canceled within a 24-hour window.  I am working  on adding a customer contact form in the Customer Portal but for now, Contact us at info@cbycgraphicdesign.com for questions related to refunds and returns

For A Product to be Eligible for a Return/Refund

It has to be in the 14 days that the Tracking shows it was delivered.

  • To be eligible for a return, your item must be unused and in the same condition that it was shipped in.
  • It must also be in the original packaging.  Everything is packaged Carefully before being shipped out unfortunately Shipping carriers are not always the most careful when it comes to handling packages. 
  • If your package arrives damaged I request you take photos of the package prior to opening it if the package arrives in less than perfect condition just in case further action needs to be taken. 
  • If you open the package and the item is damaged please notify me immediately.
Excluded Items

Several types of goods are exempt from being returned. Custom Designed – whether it is electronic files or you request an item that will either be printed or paper or vinyl cut. Custom Printed Items. Christmas Magic Kits and Personal Letters from Santa because lets face it those are 100% personalized.  Anything and everything Personalized is non-returnable.

  • Personalized Coupled Books
  • Custom Commissioned Anything
  • Personalized Anything
  • Jewelry Sorry but there is no way to change out the earring backs. (If somehow the breakage occurs in shipping Send photo proof Immediately – only possible I need to see the photos prior to approving any type of refunds)

Business Products:

I work with you to get the designs done to your specifications prior to shipping, sending photo proofs if I am doing both the designing and printing.  These items The items cannot be reused so please proofread all proofs.  I also make sure the papers matte, glossy are correct prior to shipping, If I am unsure on an item I will Print a page and send a proof prior to printing the entire order for confirmation of completing the job.  Every Opportunity is taken to make sure it is done correctly before it leaves here. No returns.

To complete your return

To complete your return, we require a receipt or proof of purchase.

 

 

Please do not send your purchase back without first reaching out to initate the return by sending an email to info@cbycgraphicdesign.com.

 

 

There are certain situations where only partial refunds are granted:

  • Any item not in its original condition, is damaged or missing parts for reasons not due to our error.
Shipping & Returns

If I accept a Return, and the Product has to be shipped back I can send you a shipping label but as a small business I am not eating the cost of shipping.  Any refunds processed will be minus the cost of Shipping as Shipping once paid is not something that can be gotten back from the post office.

To return your product, you need to first reach out to us at info@CbyCGraphicDesign.com.  DO NOT just ship something back.  Forced returns will not be accepted.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you may vary.

If you are returning more expensive items, you may consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

Refunds

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Payment Information & Storage

Payments are accepted through a secure payment processor, the site is SSL hosted. With both firewalls and additional security in place.  I do not have direct access to any credit card numbers.

 

I do not have direct access to your payment method I use a 3rd party plugin to process all payments.  The same system I use at in-person events to track sales and take payments. Only difference fewer cash options on the website.

 

I do accept a couple of alternate payment methods for those who are local. If you choose a local pick-up option. You always have the opportunity to pay Cash at Pick-up. 

 

For a Custom Order and when Bids are needed on a Project, I can also send you an invoice.

This is an Agreement between you the Customer and me, my business CbyCGraphicDesign (Creations by Crystal Graphic Design), and my website www.cbycgraphicdesign.com.

 

“You” means any individual or entity using our Services. If you use our Services on behalf of another person or entity, you represent and warrant that you’re authorized to accept the Agreement on that person’s or entity’s behalf, that by using our Services you’re accepting the Agreement on behalf of that person or entity, and that if you, or that person or entity, violates the Agreement, you and that person or entity agree to be responsible to us.

 

Types of Clients and Customers

My Business is 2 Prong I am a Designer and I am a small business Crafter.  All Physical Products sold through my website will only be shipped within the United States of America.  No Exemptions and my Reasons are listed below.

  • I am not going to deal with the hassles of international tracking,
  • customs
  • shipping internationally
  • various international selling practices
  • country-specific selling and return practices

The USA’s stuff can be enough of a headache.

I can often be found at Community Markets, Festivals, and other local events my in-person events can be found on my business Facebook page.

 

Digital Products and Projects. When it does not involve the shipping of a Product I will take each request on case-by-case bases.  I make myself available to my clients and have worked in the past on website designs and redesigns, Social media campaigns, logos, real estate fliers, business card designs as well as many other different types of projects.

 

The Question I always want to make sure of before taking on any of those clients is whether can I do the job needed and not just whether am I a good fit for the client but if the client a good fit for me.

The Following Language and Behaviors are strictly prohibited and frowned upon.

  • I welcome reviews.  You are free to express your opinion on the products but please refrain from items beyond the control of the website like issues related to shipping.
  •  
  • Malicious code/malware/spyware or other technologically harmful code.
  • Misrepresentative content. This includes but is not limited to:
    • Proliferating or creating verifiably false claims or content that could undermine participation or trust in an electoral or democratic process.
    • Deceiving users through artificial or manipulated media (images, audio, video) with the intent to influence political or social issues.
    • Content that promotes products or services using false or deceptive claims.
  • Hate speech or incitement to violence.
  • Harassment or the encouragement of the harassment of others.
  • Disclosure of others’ personal information.
  • Intellectual property infringement.
  • Impersonation with the intent to confuse, defraud, or defame any third party.
  • Please do not use the Contact Me forms to try to sell your services. 
Your Rights as one of my Shopping Customers
  1. First you have the right to know I will do my best to always keep your information secure. 
  2. I will never share or resale any information provided to me.
  3. If for some reason You contact me and want something done custom and it requires collaboration with another to complete the order I will let you know prior to reaching out to the other creator.
  4. You have the right to contact me to Cancel an order if you so choose within 24 hours of placing it for a full refund.
  5. You have a right to request your user account be closed and information removed from the server and as such I will honor it.
  6. If you order something for someone as a gift. The Transaction and purchase agreement were between you and me.  I cannot legally or morally give them the cash equivalent of the value of the purchase nor will I do an exchange.
  7. Somehow the Account Triggered the Firewall and I am not a bot how do we unlock it.  Sorry about that email me at crystal@cbycgraphicdesign.com we will get it unlocked.

Sadly we cannot escape the evils of cookies See the Section of The Cookies you Can’t Escape Sorry to know what all Applications with the website I know for sure might track data.

  • Make a purchase at one of the Markets or Festivals if it’s in person there might be a little more flexibility in what we can do but Shipping fees are non-refundable.
Shipping up to 14 days from purchase, 7-10 Business Days & Stock Level Info to Know

I’m a small handmade craft business based out of my home. I do not have a warehouse of products or supplies.  I might have a few of the designs made up. I do a lot of made-to-order.  Except for the jewelry, it is rare I have multiple of anything completely ready to ship that is finished. Well, wine bags too.

 

Most of what I need to print for business Products I have on hand, but for other items, I just might have to order supplies or go buy the right colors of vinyl.

 

Baby Books and Couple Books those I print then hand cut all the cards.  If you need something Fast Please reach out first.

  • Can be Facebook, if you want faster than the contact form.  Just because you reach out to me on Facebook does not mean you are opening yourself up to me bugging you to spend money with me
Age Restrictions

By creating an Account on this site you are agreeing you are at least 18 years of age or older and a real human being and NOT A BOT!!!!!!!!!

 

This site is targeted to adults for purchases. By Making a purchase on this site you are affirming that you are over 18 and an authorized user of the payment method chosen on the account.

 

Parents, Please know what your children are doing online and what types of content they might be accessing. There is nothing on this site that should corrupt them except I sell Personal Letters from Santa. So Don’t leave the browser open and please do not let anyone who should not have access to your payment accounts access them.  

Unauthorized Payments

So I have done everything on my end to make the payment processor and gateway as secure as possible as the customer account portal.  Here are the steps if someone makes an unauthorized payment

  2. or reach out through the contact me form.
  3. We will first start an investigation to find out some of the information about the order. I will need the following information
    1. how much was charged
    2. the date
      1. If you have any other information on the order

Next, it’s my job to start investigating.  What I will be looking for:

  1. The matching transaction.
  2. Date, Amount, Name on the account, what was ordered, where it was shipped to. If the order was shipped.
  3. Hopefully, the order is caught before it’s shipped.

If everything is caught before the order is shipped an email will be sent out stating the order has been canceled due to reported fraud. Something that could result in the account being suspended.  

 

From personal experience tho always check your late-night purchase and family member logging in with your devices and accidentally hitting pay with the card on file

Fees, Payment, Money stuff

Taxes. To the extent permitted by law, or unless explicitly stated otherwise, all fees do not include applicable federal, provincial, state, local or other governmental sales, value-added, goods and services, harmonized or other taxes, fees, or charges (“Taxes”). You’re responsible for paying all applicable Taxes relating to your use of our Services, your payments, or your purchases. If we’re obligated to pay or collect Taxes on the fees you’ve paid or will pay, you’re responsible for those Taxes, and we may collect payment from you. 

 

Payment. Yes in the payment Portal there is a place to store payment methods.  I use a 3rd party plugin to process all payments.  I only care that your credit card runs when you initiate a payment. If you do not want to store a payment method on the website. I do not at this time have any subscription options or reoccurring payment options you are free to do one-time payments rather than keeping payment methods stored in the customer portal.  But at the time of purchase:

  • You must provide accurate and up-to-date payment information.
  • By providing your payment information, you authorize us to do the payment as either a 
    1. 1-time purchase
    2. store your payment method until you request deletion.
  • If your payment fails, we suspect fraud, or Paid Services are otherwise not paid for or paid for on time (for example, if you contact your bank or credit card company to decline or reverse the charge of fees for Paid Services), we may immediately cancel or revoke your access to your account without notice to you. 

Fees and Changes. We may change our fees at any time in accordance with these Terms and requirements under applicable law. This means that we may change our fees going forward, start charging fees for Services that were previously free or remove or update features or functionality that were previously included in the fees.

Termination

you wish to terminate this Agreement, you may contact us to close your account by contacting info@cbycgraphicdesign.com. We may terminate your access to all or any part of CbyCGraphicDesign at any time, with or without cause, with or without notice, effective immediately. If we terminate this Agreement due to your violation of these Terms, we may withhold unpaid amounts or charge back your account. If we terminate your access to CbyCGraphicDesign, you are not allowed to create a new account.

My Rights and Policies as the Seller

These could be some of the reasons but are not limited to why your account could have been terminated.  This does not mean you cannot appeal it by contacting us at info@cbycgraphicdesign.com

  1. I reserve the Right to Deny Service to a customer.  The following are the list of reasons an order might be canceled.
    1. more information was needed to complete the order but it was not provided
    2. repeated attempts to gather such information were ignored
    3. Payment Method was declined
    4. When Went to purchase the shipping label there was an issue with the shipping address, 3 attempts will be made to reach the customer. If still not able to reach the customer order will be canceled
  2. Customer places 3 or more orders in a row that they then turn around and cancel the order – The account will be suspended.
  3. It is discovered you are a Bot or Spammer.

Representations, Warranties, and Disclaimers.

You represent and warrant that you have full power and authority to enter into this agreement and your participation in CbyCGraphicDesign will be in strict accordance with these Terms and all applicable laws and regulations, including without limitation all applicable laws and regulations regarding privacy and data protection, and without limiting the foregoing, you will: (i) make a privacy policy available on your site that complies with applicable law and accurately discloses your collection, use, and sharing of personal data; and (ii) be solely responsible for lawfully processing such data, including by obtaining any consents required under applicable law. We make no warranties of any kind with respect to CbyCGraphicDesign or your use of CbyCGraphicDesign.

Limitation of Liability.

 We shall not have any liability for any indirect, incidental, consequential, special, exemplary, or punitive damages under any theory of liability arising out of, or relating to, these Terms or your use of CbyCGraphicDesign. As a condition of receiving access to CbyCGraphicDesign, you understand and agree that our liability shall not exceed $5.23.

Very Good Question and I’m not sure. Thank you to open sourcing for a standard TOS with a lot of my own words put in.

This Might be overkill for a small mostly craft business but hey I’m thorough.
